Ex-juror says he favored acquittal in Wis. killing
MANITOWOC, Wis. (AP) -- A motion hearing to determine whether a convicted Wisconsin killer should get a new trial has opened with testimony from an ex-juror.
Steven Avery of Mishicot was convicted of killing photographer Teresa Halbach in 2005.
One juror in that trial was 44-year-old Richard Mahler. Avery's attorneys say Mahler was improperly excused from the jury. Mahler says his preliminary vote was not guilty. He says he was frustrated by the conduct of three fellow jurors during deliberations.
He said one fellow juror entered deliberations saying Avery was guilty. When Mahler expressed frustration to that juror later that evening the juror suggested sarcastically that Mahler have himself removed.
Mahler was excused from the jury after his wife phoned and said there was a family emergency.
