Court: Photos from cell phone search can be used


MADISON (AP) -- The Wisconsin Supreme Court says prosecutors can use incriminating photos obtained from the cell phone of a man who was stopped for speeding.

Jermichael James Carroll of Milwaukee was charged with being a felon in possession of a firearm after authorities discovered pictures on his phone in which he had guns.

A detective searched the phone after Carroll was pulled over following a high-speed chase. At one point, the detective even answered the phone pretending to be Carroll and spoke with a man who allegedly wanted to buy drugs.

A judge ruled the search of the cell phone's photo gallery was illegal and the photos could not be used in court.

In a 5-2 decision, the Wisconsin Supreme Court ruled the circumstances of the arrest justified a search warrant to get the photos off the phone.
