UPDATE: Derek Domke heads back to court

MERRILL (WAOW) -- A convicted killer returns to Lincoln County. Derek Domke of Tomahawk is now serving time in a state prison for the 2008 beating and stabbing death of Rochelle Anderson at a Tomahawk gas station. Domke has always said he didn't act alone, but police never arrested anyone else. And now he wants to withdraw his guilty plea.

At a motion hearing today in Lincoln County Court Wednesday, Domke claimed he didn't understand all of his options when he pleaded guilty to being a Party To A Murder early last year.

Domke is asking the judge to throw out his guilty plea and to re-sentence him on the charges. Investigators linked him to the killing through fingerprints.

Domke's former attorney Robert Rusch took the stand, saying he fully explained all of the options to his client before he entered his guilty plea.

"The decision whether to accept or reject the plea offer is only that of the client," Rusch explained. "My job is only to make sure he understands the offer and to assist him in making an intelligent decision."

Other witnesses taking the stand include a psychologist, testifying on Domke's mental status when he entered the plea.

It's still unclear when the judge will issue his ruling.
