Trial to test UW's power to take private property

MADISON, Wis. (AP) -- A fight between a popular bar and the University of Wisconsin-Madison heads to a courtroom Wednesday in a case that will test the school's power to take private property for a public use.

The Board of Regents has moved to condemn the property that houses Brothers Bar & Grill to make way for a new School of Music building. But the owners of Brothers are suing to try to stay put for now.

The central issue in the trial will be whether the regents have provided reasonable assurance the music building will be constructed.

If they have met that test, Circuit Judge Peter Anderson is expected to allow the university to take the property for $2.1 million. But if they haven't, he could give Brothers more time at its current location until the building gets closer to reality.
