Bar owners agree to drop UW eminent domain lawsuit

MADISON (AP) -- The owners of a popular campus bar have decided to dismiss their lawsuit that sought to stop the University of Wisconsin-Madison from taking their property through eminent domain.

Fortney, Fortney and Fortney LLC, the owners of Brothers Bar & Grill, decided Tuesday to accept the university's $2.1 million offer and allow the proposed music building to move forward.

Their attorney, Mike Wittenwyler, says they agreed to dismiss the lawsuit one day before trial because it was the right thing to do. He says it's now time for the Board of Regents to pay their costs to relocate near campus.

UW System spokesman David Giroux says the regents will pay a reasonable amount of relocation costs and negotiations continue.
