Brandenburg sentenced to 30 days in Lincoln Co. jail

LINCOLN COUNTY (WAOW) - David Brandenburg is sentenced to 30 days in the Lincoln County Jail and 3 years probation.
On November 24, 2009, he was racing another car that flipped several times and killed the passenger.
Brandenburg was originally charged with reckless endangerment.
But Lincoln County District Attorney Don Dunphy tells Newsline 9 a judge ruled Dunphy couldn't bring evidence of the fact the crash resulted in a fatality because it was "not sufficient relevance".
The charges changed. So Brandenburg pleads no contest to one count possession of methamphetamine, which was found in his system the day after the accident, obstruction of an officer and disorderly conduct.
Dunphy says a probation agent tested Brandenburg the day after the accident and methamphetamine was found in Brandenburg's system. That brought about the obstructing an officer charge.
Brandenburg will undergo counseling for three years. If he successfully completes his probation the felony charges will be expunged. His license is suspended for a year.
