Property problems for Wausau landlord

WAUSAU (WAOW)--A Wausau landlord faces fines and jail time because his tenants failed to move a couch.

Scott Albee owns 15 different rental properties in the Wausau area. After receiving a letter from the city regarding a couch and TV violating property maintenance regulations, he asked the tenants to move it.

"It's not my couch. I have no legal authority to move the couch," he said.

When the tenants failed to remove the couch, he received a second letter. The couch is now gone, but not before Albee was served with a summons and complaint.

He appeared at City Hall on December 3rd and pleaded "not guilty" to the violation.

"Well, I'm going to court. I'm not sure how it's going to turn out. I could be fined up to $1,000 dollars or go to jail."

Attorney Sarah Ruffi handles a lot of landlord and tenant cases. She said even if Albee took action before being sighted for a property maintenance violation, it wouldn't necessarily change the outcome.

"If the tenant refused to move both items and you tried to sue them, to evict them based upon their violation, the court would most likely say that's not a substantial breach entitling you, Mr. Landlord, to an eviction of your tenant."

Albee is determined to fight the violation. His court date has not been set.
