MARATHON COUNTY (WAOW) -- The Weston father convicted of praying over his daughter, instead of taking her to a doctor, heads back to court.

Dale Neumann's current attorney is asking for a new trial, saying Neumann's previous lawyer didn't do a good enough job. A jury found both Neumann and his wife, Leilani, guilty of second-degree reckless homicide in 2009. Their daughter died due to complications from untreated diabetes.

"For a jury evaluating the context and the like, it would be my opinion that knowledge of prior conviction would have to influence their decision," said Jay Kronenwetter, Neumann's former attorney.

Neumann's new attorney said the original jurors were influenced by Leilani's guilty verdict which was decided before Dale's case started. Leilani appeared in court last week, also looking for a new retrial. The judge said he plans to make a ruling on the cases by the end of April.
