Emerson asks for appeal

MARATHON COUNTY (WAOW) -- The man convicted in the murder of Rhonda Mertes heads back to court to try and get a new trial. Post-conviction oral arguments are underway in the case of James Emerson. Emerson wants an appeal. He claims he didn't have sufficient representation. He appeared by phone Monday. Prosecutors say the evidence supports the conviction. Emerson was convicted in 2009 and is serving time for the 1999 murder of Mertes. He has a deadline of March 18 to file an extension with the court of appeals.
