Wrestler's attorney asks that charges be dropped


WOOD COUNTY (WAOW) - The lawyer for a wrestler charged with misconduct wants the state to drop misconduct charges against his client and four other Wisconsin Rapids wrestlers.

  Gary Kryshak represents Zachary Benitz but filed the motion on behalf of all four Wisconsin Rapids Lincoln High School wrestlers accused of sexual misconduct in the locker room.  Benitz, Kasey Einerson, Rylan Lubeck and Devin Peterson are charged with misdemeanor disorderly conduct.

  The motion filed Thursday by Kryshak says Assistant District Attorney Craig Lambert told Kryshak the alleged victim either retracted certain statements or the investigator misunderstood the statements.

  Kryshak asked that if the complaint is not dropped, that it instead be clarified as to what the alleged victim claimed happened.

  Newsline 9 called Lambert but was told the assistant district attorney was  out of the office.

  All four wrestlers are due in court again on February 2nd, 2012.
