Portage County fatal crash investigation finished


The Portage County Sheriff's Office has concluded its investigation into the one vehicle fatal crash that occurred on April 29, 2012, at approximately 02:37 a.m., on State Highway 66 in the Town of Linwood.

The three occupants of the vehicle were identified as:

Driver: Scott D. Dean, 29 years old, Whiting, Wisconsin

Occupant: Nicholas J. Czech, 25 years old, Stevens Point, Wisconsin

Occupant: Joseph C. Trzebiatowski, 19 years old, Linwood, Wisconsin

The investigation, which spanned several weeks and included many potential witnesses and
sources of information, revealed no additional credible information to change the preliminary
findings that were released on April 30th. The Sheriff's Office has concluded that the most likely
scenario, based on the evidence to a reasonable degree of certainty, was that Scott Dean was operating the motor vehicle at the time of the crash. Dean had a blood alcohol concentration of 0.343 grams/100 milliliters of blood, over 4 times the legal limit for most motorists in Wisconsin.

Crash investigators from the Sheriff's Office concluded that alcohol, excessive speed, and lack of
seatbelt use were all considered to be contributing factors.

As a result of the investigation, it was also determined that 19 year old Joseph Trzebiatowski had been served alcohol that evening at Morey's Bar, in the Town of Hull. A citation was issued to Leeloni Herrera of Stevens Point, for providing alcohol to an underage person. Herrera was the bartender who served Trzebiatowski on that evening.

Detectives from the Sheriff's Office concluded that there was insufficient legal evidence to support any additional charges, and that any further inquiry would not realistically advance any criminal case. The investigation is considered to be closed.
