Wis. woman charged after SUV kills pedestrian

MILWAUKEE (AP) -

A Milwaukee-area woman whose SUV struck and killed a pedestrian last autumn has been charged with homicide by intoxicated use of a vehicle.

Prosecutors said Monday that 31-year-old Josephine E. Sardina was reading a text message around the moment of the collision. They also say she had marijuana's active ingredient in her system.

The victim was identified as David Budge. A witness told investigators Budge tried to jump out of the way before he was struck last October. The medical examiner's office says Budge died of blunt-force trauma consistent with trying to evade a vehicle.

The criminal complaint says Sardina heard a thud and saw Budge on the ground. She ran to check on him and then called 911.

She also acknowledged smoking marijuana and said she has back problems.
