Oneida County man's appeal rejected by state's high court

The Wisconsin Supreme Court rejects an Oneida County man's appeal.

Matthew A. Lonksoki was convicted of recklessly causing great bodily harm and neglecting a child resulting in death.

His 10-month old daughter, Peyton Marie died after accidentally eating a morphine pill in May of 2009, while he was caring for her, in their Town of Pelican home.

Lonkoski claimed police  continued to interrogate him about his daughter's death after he asked for an attorney.

The high court issued a 28-page opinion that says Lonkoski was not in police custody when he asked for an attorney, so detectives were not required to stop questioning him.

Lonkoski is currently serving a 12 year prison term in connection with the death of his daughter.
