Sentencing of ex-sheriff's wife postponed to July 1


WAUSAU (WAOW) - The sentencing of the wife of former Marathon County Sheriff Randy Hoenisch in a drug-related case has been postponed until July 1, according to online court records.

Kim Hoenisch, a 41-year-old one-time state probation agent, was convicted of three felonies - burglary, misconduct in office and possession of narcotic drugs - and two misdemeanors after pleading no contest to the charges. She was to be sentenced Monday.

Hoenisch was fired from her job after a state investigation concluded she had stolen prescription drugs from one of her clients.

According to online court records, a motion was filed Tuesday seeking to "strike" the presentence investigation prepared for the judge.

Hoenisch's attorney, Harry Hertel, said Thursday the 31-page report, prepared by the state Department of Corrections, is inaccurate and unfair to Hoenisch.

Hertel said he wants the judge to order a new one from a "neutral" source plus Hertel said he needs more time to file an alternative presentence report.

Winn Collins, the special prosecutor from the state attorney general's office in Madison, did not immediately return a telephone message Thursday.

According to the criminal complaint, Hoenisch burglarized the home of a probationer last June in search of pain medicine. Hertel said she's battled addiction since the 1990s due to "horrible pain from multiple knee surgeries."

Prosecutors have said they will recommend that Hoenisch be sentenced to 18 months in prison and two years probation. Hertel said he would argue for probation with some jail time.

Hoenisch's 57-year-old husband announced his retirement as sheriff in February and officially stepped down March 23. Hoenisch, who was under criticism for his work habits, won his first election in 2000, and he was re-elected three times.
