Adams Co. man pleads insanity in killing


ADAMS COUNTY (WAOW) – A former Marine from Adams County who police say fatally shot his girlfriend after being startled in bed pleaded insanity on Wednesday to first-degree reckless homicide.

Coleman Dybul, 28, is accused of killing 27-year-old Toni Voss in March. The criminal complaint said “Dybul stated, 'Honestly, it was like being back in Afghanistan, kill or be killed.”

Prosecutors said psychiatrists will now be appointed by a judge to examine Dybul.

With the insanity plea, Dybul claims he is not guilty by reason of mental disease or defect and he was unable to know right from wrong at the time of shooting.

A six-day trial is scheduled to begin Dec. 6, according to court records.

Investigators said Dybul told them he was sleeping, he was startled, he grabbed a shotgun alongside the bed, he thought Voss was being attacked and he shot her. He then called 911.

Court records said Dybul told police he served in the Marines and was diagnosed with post traumatic stress disorder.

Dybul remained in jail Wednesday on $250,000 cash bond, prosecutors said.
