Rhinelander man gets deal in shooting uncle

RHINELANDER (WAOW) - A Rhinelander man accused of shooting his uncle in the abdomen has pleaded guilty to one felony in a plea agreement, but it could be dismissed in a year, a prosecutor said Wednesday.

Marcus L. Alsteens, 23, of Rhinelander, was charged with attempted first-degree intentional homicide, aggravated battery and injury by negligent use of a weapon or explosive in the Aug. 12 shooting of 49-year-old Justin F. Alsteens at the home they shared in Rhinelander.

The criminal complaint said an argument over household chores prompted the shooting that critically wounded the uncle.

During a court appearance Tuesday, prosecutors dismissed the first two counts, and Alsteens pleaded guilty to the third, court records said.

The deal includes a deferred judgment agreement, meaning Marcus Alsteens will be put on informal supervision with conditions for the next year and if he stays out of trouble, the charge will be dismissed, District Attorney Michael Schiek said.

Schiek said the uncle told a far different story about what happened than was originally charged.

The uncle, after he recovered from his injuries, told investigators the shooting was an accident when Alsteens was showing him a gun and there was no argument, Schiek said.

"The stories were completely different," the prosecutor said. "It was a crazy turn of events. Something we certainly didn't anticipate."

Alsteens spent 169 days in jail before Tuesday's developments, court records said.

At one point in the proceedings, Alsteens pleaded not guility and not guilty by reason of mental disease or defect. He was evaluated by doctors, determined competent and he withdrew the insanity pleas, court records said.
