DEVELOPING: Steven Avery's attorney files paperwork asking for extension

The attorney for Steven Avery has filed a motion with the State Court of Appeals in Madison to ask for an extension in her appeal of his murder conviction.

Kathleen Zellner has until Monday to file the formal extension, but she faxed in her paperwork in Madison on Friday morning. Her appeal involves Avery's conviction in connection with the murder of Teresa Halbach in Manitowoc County in 2005. The murder case received national attention in the Netflix series “Making a Murderer.”

According to the motion filed in court on Friday, Zellner is asking the appellate court to temporarily suspend the appeals process.

“Because the results of the requested testing and any subsequent litigation could result in Mr. Avery’s conviction being overturned, it is appropriate to hold this appeal in abeyance pending the results of that testing and any subsequent litigation in the circuit court, should testing be granted.”

There's no information in the motion about what kind of evidence or testing Zellner wants, but previous reports state Zellner wants to order new scientific DNA testing of the evidence related to the murder case that she says wasn't available at the time of Avery's trial. Zellner says the new evidence could prove that her client, Steven Avery, is innocent.

The request from Zellner comes after Avery's nephew, Brendan Dassey, had his conviction overturned by a federal judge earlier this month.
