Two charged with lascivious behavior in Wausau parking ramp incident


WAUSAU (WAOW) - What started out as an early-morning noise complaint at a downtown Wausau parking ramp turned into police discovering two homeless people involved in sex acts in an elevator lobby, according to a criminal complaint.

Brian Bentz, 57, and Barbara Maloney, 38, were each charged with misdemeanor lewd and lascivious behavior in Thursday's incident at the Jefferson Street ramp. They pleaded not guilty during brief court appearances later in the day, court records said.

Police went to the ramp about 2:45 a.m. and discovered the pair on the floor - Maloney being naked - as Bentz fondled her in front of a "well-lit" glass-paned door where people pass through regularly, the complaint said. Another man sat nearby,

Maloney was "very embarrassed and apologetic," and Bentz told an officer he thought what happened was "acceptable behavior" in a public place and he was unaware he could get in trouble, the complaint said.

"Barbara and Eric both confirmed they knew they were not supposed to be living in the ramp," the document said. "They had blankets and sheets and sleeping bags set up."

The pair said it was too cold to sleep outside since the warming center was closed, the complaint said. Alcohol was found at the scene.

Maloney is also charged with misdemeanor bail jumping in violating terms of a bond in an unrelated incident.
