Kasten won't head to prison

MARATHON CO (WAOW) --  The Wausau woman police say drove drunk with her two children in her car, less than two months after she was sentenced to probation in the death of her son, won't head to prison.

In April, 26-year-old Jessica Kasten was sentenced to ten years probation, after police say she used meth, then woke up to find her son dead. In May, police say she was arrested for drunk driving, with her children not properly fastened in the car.

On July 17, a closed hearing was held to decide whether Kasten's probation would be revoked. That's what the Department of Corrections has requested. The judge did uphold Kasten's violations -- but said her offenses did not warrant prison time.

Corrections Field Supervisor Mike Williams tells Newsline 9 he does plan to appeal this decision. There is an August 5 deadline. Kasten will either remain on probation, or in the Marathon County jail, depending on the appeal outcome.
